Challenge Terms & Agreement

By submitting, signing, or electronically acknowledging the Tipsy Kornhole Release of Liability, Assumption of Risk, Waiver of Claims, and Indemnification Agreement (the “Waiver”), Participant expressly acknowledges, understands, and agrees that they are also entering into and bound by the Tipsy Kornhole Challenge Terms & Agreement (the “Challenge Agreement”), including all applicable Challenge Rules, where applicable.

Participant agrees that submission of the Waiver constitutes full acceptance of the Challenge Agreement, the Challenge Rules, and any associated promotional challenges, wagers, contests, giveaways, or prize-based activities conducted by Tipsy Kornhole.

Participant further acknowledges and agrees that:

1. Participant has read, understood, and agrees to comply with all applicable Challenge Rules governing participation in the Challenge;

2. The Challenge Agreement governs all promotional wager terms, including any requirement that Participant follow Tipsy Kornhole on Instagram and X (formerly Twitter) if Tipsy Kornhole wins the applicable Challenge;

3. The Challenge Agreement governs all promotional prizes, including eligibility to receive a pre-approved custom drinking cornhole board if Participant wins an applicable Challenge;

4. Any custom board prize is subject to prior approval by Tipsy Kornhole and must remain within reasonable creative boundaries as determined by Tipsy Kornhole in its sole discretion;

5. The Challenge Agreement operates as a separate but binding agreement, independent of the Waiver, and applies specifically to promotional, entertainment, and competitive Challenge activities; and

6. Participant's acknowledgment of the Waiver serves as confirmation that Participant has had the opportunity to review the Challenge Agreement and Challenge Rules and voluntarily agrees to be bound by all applicable terms and conditions.

By submitting the Waiver, Participant confirms that they have read, understood, and voluntarily agree to be legally bound by the Challenge Agreement, the applicable Challenge Rules, and all other terms and conditions contained in the Waiver. Participant further acknowledges that they have had the opportunity to review the Challenge Rules in their entirety and agree to comply with all requirements, procedures, and obligations governing participation in the Challenge.

Challenge Rules

1. Each team must consist of two (2) participants: one male and one female.

2. Both team members must participate throughout the entire Challenge. No substitutions are permitted after the Challenge begins unless approved by Tipsy Kornhole.

3. The Challenge will be played in a best two (2) out of three (3) match format.

4. The first team to win two (2) matches will be declared the winner of the Challenge.

5. Each match must be played using a different difficulty level or challenge format selected by the Challengers before the Challenge begins.

6. The same difficulty level or challenge format may not be used in more than one match.

7. All selected difficulty levels and challenge formats are subject to approval by Tipsy Kornhole and may be modified or rejected for safety, fairness, or operational reasons.

8. Match scores reset at the beginning of each new match.

9. All participants must follow the instructions of Tipsy Kornhole representatives and comply with all Challenge rules.

10. Any cheating, unsportsmanlike conduct, intentional rule violations, or attempts to gain an unfair advantage may result in immediate disqualification.

11. Tipsy Kornhole reserves the right to make final decisions regarding scoring, rule interpretations, eligibility, and any disputes arising during the Challenge.

12. If a team wins the first two matches, the third match will not be played unless otherwise determined by Tipsy Kornhole.

13. By participating in the Challenge, all participants acknowledge and agree to these rules and any additional terms, waivers, or requirements established by Tipsy Kornhole.
